Hourly Consultation Terms & Conditions
Studio Bowerbridge, the (‘Designer’) will provide advice and expertise during a consultation with the (‘Client).
1. Obligations of Designer
1.1 The Designer will provide design advice during a consultation held either remotely or in-person. These consultations typically cover issues such as layouts, colour schemes, fabrics choices and furniture placement. The topics for discussion should be provided in advance by the Client through the enquiry form.
1.2 There is no obligation for the Designer to return any ‘deliverables’ for hourly consultations such as email guides, moodboards or colour schemes. The Designer will send a follow up email with a summary of what was spoken about during the consultation. They may occasionally send further details or specific links but this is not obligatory and under the discretion of the Designer.
2. Client Responsibility
3.1 The client must fill in the pre-consultation questionnaire, along with sending over any relevant files prior to the consultation. It is the responsibility of the client to make sure the designer has everything they need for the consultation at least 3 working days in advance. Should we not receive these details in time, the appointment may need to be rescheduled.
3.2 The Client remains solely responsible for ordering all products, sourcing and securing suppliers, managing installation and deliveries/returns. The Client must confirm delivery/refund policies directly with each supplier and inspect all delivered items immediately for damage/defects and report these directly to the supplier. The designer is not responsible for any damaged goods.
3.3 The Client is responsible for ordering all samples required for the project, including paint samples.
3.4 Measurements - it is the sole responsibility of the Client to ensure measurements provided are taken correctly. The Designer is not responsible for any incorrect measurements nor any fees that may be incurred from Client errors.
4. Copyright and Licensing
Any ideas, moodboards or sketches shared by the Designer during the consultation remain the exclusive property of the Designer. Clients may use the files for their personal project only and must not be reproduced, distributed or sold without the Designer’s prior written permission.
5. Fees
5.1 Fees for hourly consultations are payable at a rate of £195/hour + VAT. There is a 10 minute grace period to finish answering specific questions at the end of a call. Any time after this will be charged as a full additional hour.
5.2 Payment must be made in advance. If payment is not received before the scheduled start date, the client’s slot may be given up.
5.3 Fees will include VAT at 20%. Studio Bowerbridge is registered for VAT in the United Kingdom- registration GB427824774
5.4 In-person appointments will incur travel fees at 0.45p/mile plus a reduced hourly rate of £30/hour travel time. Other travel expenses will be billed directly to the client such as train tickets/flights/taxis. If an overnight stay is necessary, this will be confirmed with the Client prior to booking and will incur a £250/night accommodation and meal allowance. The Designer is not responsible for delays to travel nor any additional costs as a result of these delays.
6. Cancellations & Refunds
6.1 Hourly Consultation slots are non-refundable once booked. No refunds are given if the Client cancels the services within 4 weeks of the anticipated start date. An appointment may be rescheduled to a future date if at least 7 days notice is given. Availability will be subject to our studio calendar.
6.2 50% of the total fee will be returned if the consultation is cancelled prior to the 4 week notice period.
6.3 If the Client ends the call prior to the time allowance, the Client is not entitled to a refund or prorated credit.
7. Limitation of Liability
7.1 The Designer’s work ends once the consultation is finished after the allotted time slot. Dissatisfaction with style preferences or colours does not entitle the Client to compensation of a refund.
7.2 The Designer has no financial responsibility for ordering errors due to Client supplied measurements or access restrictions.
7.3 The Client must ensure compliance with local building regulations. The Designer is not liable for any related issue to do with planning or regulation.
7.4 The Designer makes no warranties regarding third party services or products recommended as part of the design service.
7.5 Digital or print/sample colours for fabrics and paint may vary from actual colours or finishes. The Designer has no responsibility for these variations and the Client accepts the risk of these small variations.
7.6 Under no circumstances does the Designer’s total liability exceed the fees paid by the Client. No indirect or consequential damages will be covered.
8. Working Hours/Correspondence
8.1 Working Hours - our Designers work Monday - Friday 9am - 5pm. Emails/calls will be answered within 48 hours during these working days. We take consultation calls on a Tuesday or a Friday, with some flexibility for specific date requests. The Designer may occasionally share project photos or communicate through Whatsapp but this communication is limited by standard working hours.
8.2 Please note, we take a yearly break for 2 weeks during August and over Christmas to rest and creatively recharge. This is paramount for the health of our employees and our overall efficiency as a business. We publish reminders about these yearly breaks in advance.
9. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website constitutes acceptance of the revised Terms.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
