Virtual Design Terms & Conditions
Studio Bowerbridge, the (‘Designer’) will provide virtual design services for you, the (‘Client).
1. Obligations of Designer
1.1 The Designer will provide virtual design services as set out in the Client’s initial invoice. These typically include creative design concepts, moodboards, colour schemes, 2D layouts/ retail shopping lists.
1.2 These services include one round of revisions to the initial concept. Any further revisions or additions to the initial scope of the project, will be charged at the Designer’s hourly rate.
2. Delivery of Final Files
Final files will be delivered in PDF format to the Client. The Designer’s work ends once files have been delivered. Dissatisfaction with style choices or colours/personal taste preferences does not entitle the Client to a refund or any other compensation.
3. Client Responsibility
3. 1 The Client remains solely responsible for ordering all products, sourcing and securing suppliers, managing installation and deliveries/returns. The Client must confirm delivery/refund policies directly with each supplier and inspect all delivered items immediately for damage/defects and report these directly to the supplier. The designer is not responsible for any damaged goods.
3.2 The Client is responsible for ordering all samples required for the project, including paint samples. The Designer may provide fabric samples where relevant (these may occur a small charge or be loaned out to the Client).
3.3 Measurements - it is the sole responsibility of the Client to ensure measurements provided are taken correctly. The Designer is not responsible for any incorrect measurements nor any fees that may be incurred from ordering errors.
4. Copyright and Licensing
All files and design concepts remain the exclusive property of the Designer. Clients may use the files for their personal project only and must not be reproduced, distributed or sold without the Designer’s prior written permission.
5. Fees
5.1 Payment must be made in advance. If payment is not received before the scheduled start date, the client’s slot may be given up.
5.2 Fees will include VAT at 20%. Studio Bowerbridge is registered for VAT - registration GB427824774
5.3 In-person consultation appointments will incur travel fees at 0.45p/mile plus a reduced hourly rate of £30/hour travel time. Other travel expenses will be billed directly to the client such as train tickets/flights/taxis. If an overnight stay is necessary, this will be confirmed with the Client prior to booking and will incur a £250/night accommodation and meal allowance. The Designer is not responsible for delays to travel nor any additional costs as a result of any delay.
6. Cancellations & Refunds
6.1 Virtual design services are non-refundable once the designer has begun work. No refunds are given if the client cancels the services within 4 weeks of the anticipated start date.
6.2 50% of the total fee will be returned if cancelled prior to the 4 week notice period.
7. Limitation of Liability
7.1 The Designer’s work ends once the final files are handed back to the Client. Dissatisfaction with style preferences or colours does not entitle the Client to compensation of a refund.
7.2 The Designer has no financial responsibility for ordering errors due to Client supplied measurements or access restrictions.
7.3 The Client must ensure compliance with local building regulations. The Designer is not liable for any related issue to do with planning or regulation.
7.4 The Designer makes no warranties regarding third party services or products recommended as part of the design service.
7.5 Digital or print/sample colours for fabrics and paint may vary from actual colours or finishes. The Designer has no responsibility for these variations and the Client accepts the risk of these small variations.
7.6 Under no circumstances does the Designer’s total liability exceed the fees paid by the Client. No indirect or consequential damages will be covered.
8. Working Hours/Correspondence
8.1 Working Hours - our Designers work Monday - Friday 9am - 5pm. Emails/calls will be answered within 48 hours during these working days. We take consultation calls on a Tuesday or a Friday, with some flexibility for specific date requests. The Designer may occasionally share project photos or communicate through Whatsapp but this communication is limited by standard working hours.
8.2 Please note, we take a yearly break for 2 weeks during August and over Christmas to rest and creatively recharge. This is paramount for the health of our employees and our overall efficiency as a business. We publish reminders of these yearly breaks in advance.
9. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website constitutes acceptance of the revised Terms.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
